DotFuns Member Service Terms of Use

Welcome to join us and become a member of Dotfuns. Dotfuns member service (hereinafter referred to as Member Service) is offered by “Elite Design” (hereinafter referred to as Company). All members (hereinafter referred to as Member) who use the Member Service should read the details of the following terms and conditions. The purpose of entering into these terms and conditions is to protect the provider of Member Service and benefits of all members. The terms and conditions also constitute the agreement between Member and Member Service provider. When a Member completes registration procedures or starts using Member Service, the Member is deemed to be aware of and completely agree to terms and conditions of Member Service. In the meanwhile, the Company owns operation of power and ownership of all services of the Company.

• Member Service
  • The Company reserves the right at any time to increase, decrease or change whole or part of service item, content and function without prior individual notice.
  • The Company will take the initiative to send regular or irregular electronic news or E-DM to Member. If any Member decides not to receive electronic news or E-DM, please inform us to cancel the subscription.
  • Member explicitly agrees that Member shall personally take the risk of using information service.
  • The Company shall not take responsibility of any direct, indirect, occasional, particular and ensuing damages. These damages might come from improper usage of the website service or the message sent by the Member does not comply with provisions. These conducts may result in damage to Company image. Thus, the Company brings up in advance the possibility of such damage and in the meantime tries to avoid occurrence of such damage.
• Account, password and security
  • Member can choose Member’s own e-mail address and password for registration. However, Member has the obligation to keep it confidential or in proper self-safekeeping. The e-mail address and password shall not be released or rendered to the third party for usage. For conducts of using particular e-mail address and password in Member Service and all conducts after logging into the system, the Member, who holds the e-mail address and password, shall take full responsibilities.
  • If Member finds or doubts that the Member’s e-mail address and password are misused or stolen by the third party, the Member should inform the Company immediately so that the Company can take proper counter-measures in time. However, the aforesaid counter-measures should not be interpreted as that the Company is being held accountable, either implicitly or explicitly, for any compensation or reparation obligation for the Member.
• Personal Information and Member Privacy Policy
  • Respect for Member privacy is a fundamental policy of this website. Therefore, this website will definitely not to open, edit or disclose Member’s registration information and the non-public information kept in this website without prior legal authorization of the Member. Furthermore, the Company will not render Member’s personal information to third party without prior consent of the Member. Unless it is permitted by law or this website believes that it is necessary to disclose Member’s information on the basis of good faith for the following conditions:
    • Comply with relevant laws and regulations, and comply with legal service procedures of this website.
    • Retain and safeguard ownership of trademarks of this website.
    • The Member authorizes the Company to disclose information.
    • Corresponding laws and procedures request the Company to render Member’s personal information. If the provided data of the Member contains incorrect information, the Company reserves the right to terminate Member’s qualification for using information service of the Company.
    • In case of emergency, the Company will make every effort to protect the privacy and safety of the Member and the public.
    • Conform to other relevant request.
    • This website reserves the right to publish demographic analysis and consultation of Members.
  • Member agrees:
    • To provide timely, detailed and accurate personal information.
    • To receive information from the Company.
    • To constantly update registration information to meet timely, detailed and accurate requirements. All originally typed information will be used as registration information.
  • While registering, Member shall select an e-mail address with relatively better reliability and security. Member shall also agree to receive and read all types of e-mails sent by the Company. The related e-mail shall be regarded as being received by the Member as long as the Company successfully sends out the e-mail to the Member under the conditions that the e-mail cannot be received or read normally due to (1) the Member does not timely receive the e-mail from the Member’s own e-mail address, or (2) the problem of Member’s e-mail address or the problem of receiving and reading e-mail of the Member. The delivery time of the e-mail recorded on the Mail Server shall be regarded as e-mail arrival time for the Member.
• Data Storage
  • Member shall personally backup all uploaded, published or stored data in this system. The Company will regularly backup stored data of Member according to the established manner and process capacity of this system at the time. However, the Company does not guarantee that the backup of Member’s data stored in this system is complete. The Member agrees that the Company shall not be responsible for non-backed up and deleted data or failed backup of stored data.
  • This system does not guarantee that Member’s uploaded data will be correctly displayed, or does not guarantee accuracy of data transmission. If Member finds system error, please immediately inform website administrator of this system.
• User Conduct
  • Member shall not engage in commercial conduct without prior authorization.
  • Send any e-mail, file or data which violates ROC technical data output related laws and regulations.
  • Publish, transmit, send or store any work or data which violates other people’s intellectual property rights or other rights and interests.
  • Collect other people’s e-mail address and other personal data without consent.
  • Arbitrarily extract or use whole or part of database content of the Member Service without authorization.
  • Publish, transmit, send or store virus or any other program or information which may be adequate to damage or interfere with computer system or information.
  • Damage or interfere with system operation of the Member Service, or any conduct which violates general courtesy of internet.
  • Enter into Member Service system or network related the system without authorization.
  • Any conduct which obstructs or interferes with other people’s use of Member Service system.
  • Any conduct for stealing Member’s account, password or access rights through improper channel.
  • Other conduct which does not comply with purpose of usage provided by the Member Service.
  • Member information service cannot be used for illegal purpose, and Member shall not interfere with or confuse internet services. Member agrees to abide by all internet protocols, regulations, procedures and conventions of the used system. Member’s Code of Conduct is determined based on network regulations, policies, procedures and conventions.
  • If any words, pictures, videos, files or other works or data, which have been uploaded, published, transmitted, sent or stored by Member or the third party, (1) violate laws or damage rights and interests of the third party, or (2) violate usage provisions of this system or other usage specifications or agreement, or (3) involve tort or other legitimate dispute suggested by the third party, the Company has the rights at any time without notification to directly delete, move or stop access to these words, pictures, videos, files or other works or data, or the Company will terminate whole of part of Member Service for the Member. Member with such conducts shall take full legal responsibilities and liabilities for the damages generated by the Member’s conducts. The Member shall also be held accountable for any damages and costs caused to the Company and shall be responsible for any compensation and reimbursement to the Company.
  • The Company has the right to determine whether a Member’s conduct complies with requirements and spirits of service provisions of the Company. If the Member violates any service provisions of the Company, the Company has the right to terminate the Member’s account.
  • Member agrees to protect and safeguard the interests of all Members of this website and takes the responsibility of paying (1) any attorney expenses caused by Member’s usage of this website which is beyond the scope of service, (2) any compensation costs for the damage due to Member’s breach of service provisions, and (3) any damage costs caused by other people’s usage of the Member’s computer, account and other intellectual property rights.
• Right of Ownership
  • Member Service of the Company only provides related system for Member to use. Member thereby does not obtain authorization for relevant trademark, copyright or other intellectual property rights of the Company and individual Member Service.
  • With no objection, Member agrees that the Company provides specific or non-specific person with online browsing, query, retrieving, offline reading or receiving in an appropriate manner, including different produced or converted versions or formats for software or hardware upgrades, such as the version for online reading and different versions and formats for various computer equipments to download data (including PDA, mobile phone, and similar equipments which will be developed in the future).
  • If Member participates in any related activity of the Company, the Company may take pictures of the activity. If there is any photo of the Member, the Member agrees with no objection to allow the Company to use the photo, including right of portrait, in propaganda or promotional activities without individual notification.
  • The information content defined by this website includes: words, software, sound, photos, videos and graphics; entire content of the advertisement; other information provided for Member by this website. All the aforesaid content is protected by the laws of copyright, trademark, label and other property rights. Therefore, Member can only use the content that is authorized by this website and advertiser; Member cannot copy without authorization, reproduce the content, or create derivative product which is related to the content.
  • The trademarks, copyrights, other intellectual property rights and data ownership of web page design, interface, URL, trademark or logo, computer programs and database, which are provided by the Member Service, all belong to the Company or legal rights holder who authorizes the Company for usage.
• Exclusions and Limitations of Responsibility
  • Member Service of the Company shall only provide specific request or demand to user according to functions and conditions at the time of the services, including but not limited to security, reliability, completeness, accuracy and mistake. The Company shall not be responsible implicitly or explicitly for any warranty and guarantee.
  • If there is any direct or indirect damage caused by the usage itself of the Member Service, which is provided by the Company, the Company shall not take any responsibility and liability, even if there is recommendation which has been explicitly suggested by the Company
  • The Member Service of the Company only provides Members with related server space and system. Member thereby does not obtain authorization for relevant trademark, copyright or other intellectual property rights of the Company and individual Member Service.
• Suspension, Interruption or Termination of Service
  • If there is any service suspension or interruption, which is caused by routine system maintenance, separate setting or change of the Company system or Member Service, the Company shall inform Member via e-mail, announcement or other appropriate way before service suspension or interruption.
  • For any of the following conditions, the Company shall suspend or interrupt whole or part of the Member Service and shall not be liable for all direct or indirect damages caused to the user:
    • The Company is conducting relocation, replacement, upgrade, maintenance or repair for related software and hardware;
    • The user commits a breach of laws and regulations, this Terms of Use of the Member Service, or any usage specifications or agreements;
    • Member Service is stopped or interrupted due to the conduct of third party, natural disaster or other force majeure;
    • Member Service is stopped or interrupted due to other factor which is beyond the Company’s full control, or the factor is not attributable to the Company.
  • If Member violates this Terms of Use or usage specifications or agreement of the Member Service, the Company reserves the right to suspend or terminate service at any time and shall not be liable for any compensation or reparation.
  • If Member opposes against any suggestions provided by the service provisions or amendments to the service provisions, or if Member is discontented to this website service, Member can exercise the following rights:
    • No longer using information service of this website.
    • Inform this website to terminate service of the Member.
    After Member service is terminated, the right of using this website service is terminated immediately. Since then, the Member has no right, and the Company has no obligation to deliver any unhandled data or incomplete service to the Member or the third party.
• Amendment of This Terms of Use
  The Company reserves the right to revise at any time Member Service provisions and the usage specifications or agreements. The revised content of this Terms of Use shall be posted in the relevant web page of the Member Service website without sending additional individual notice to user.
• Governing Law and Jurisdiction
  • This Terms of Use and relevant usage specifications and agreements of the Member Service shall be governed by, construed and interpreted in accordance with the laws of the Republic of China.
  • Should any disputes or litigation arise over or in connection with Member Service, or this Terms of Use and relevant usage specifications and agreements of the Member Service, Taiwan Taipei District Court shall be the jurisdiction court of first instance.
